The Muse Company Limited (hereinafter referred to as "we", "us", or "our") operates the website and the service known as Muse Garden (the "Service"). These Terms & Conditions (the "Terms") govern your access to and use of our Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Use of the Service

The Service allows you to browse, select, and purchase flowers and related products (the "Products"). By placing an order through the Service, you warrant that you are legally capable of entering into binding contracts.

2. Products

All Products shown on our Service are subject to availability. We will inform you by email or phone if the product you have ordered is not available.

3. Price and Payment

The price of any Products will be as quoted on our Service, except in cases of obvious error. These prices include VAT but exclude delivery costs, which will be added to the total amount due.

4. Delivery

Delivery charges and timescales vary depending on the type of Products ordered, the service you select, and the delivery address. We will make every effort to deliver your order within the estimated timescales, but delays are occasionally inevitable due to unforeseen factors.

5. Cancellation and Returns

Muse Garden does not offer refunds on orders cancelled within 48 hours of the delivery date.  Orders cancelled beyond of 48 hours of the intended delivery time will incur a 50% of the product price as a cancellation charge.  Notice of order cancellation should be made in written via email to the shop you place your order.  Refunds can only be credited back to the credit card that was used for the original purchase.

6. Intellectual Property Rights

All intellectual property rights in the materials on our Service, including without limitation, the design, text, graphics, and their selection and arrangement, belong to The Muse Company Limited or its licensors. You may not use such materials without our prior written consent.

7. Liability

Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the date at the top of the Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you a notification).

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Hong Kong. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
